Travel Terms and Conditions

These terms and conditions apply to all travel packages offered by Tilman Safaris hereby also referred to as The Safari Company to clients/guests and stakeholders.

TRAVEL DOCUMENTS

It is of utmost importance that you thoroughly check your visa requirements before your intended date of travel, as Tilman Safaris will not be held responsible should the necessary visa requirements not be fulfilled. The client acknowledges that it is his responsibility to ensure that he/she is in possession of the necessary valid travel documents,identifications cards, passports, visas, vaccination certificates e.t.c

 

BOOKING AND PAYMENT

All reservations can be made by email, phone or visit our offices and only confirmed after 25% deposit of the total amount has been paid. The balance should be paid not later than 30 days before the commencement if the safari/tour.

In the event of a booking less than 30dyas prior to the start of the tour/safari,payment in full is to be made upon booking the tour.

The payment is NET of all bank charge, both on sending and receiving. All payments should be made either by Lipa na Mpesa, Visa or Paypal through telegraphic transfer to Tilman Safaris bank account to be provided. Credit card  payment will attract a 10% bank surcharge. Should a cheque issued by the clients be returned by the bank for any reason the client shall replace within seventy-two {72} hours with certified funds. Returned cheque will be charged USD 50.00. Let us know which method is preferable for you.

CANCELLATION POLICY

Cancellation or reduction in the number of days must be notified and will take effect the is it is received . Cancellation fee will be due and payable as follows:

  1. Between 61 & 75 days, 15% of the total cost will be charged
  2. Between 45 & 60 days, 25% of the total cost will be charged
  3. Between 31 & 45 days, 50% of the total cost will be charged
  4. Between 30 & a “No show” 100% of the total cost will be charged

No refund is available for cancellation after the commencement of tour arrangements or on any service not used

TRAVEL ARRANGEMENTS

All travel arrangements such as flight bookings, reservation of hotel accommodation, reservation of motor transport mad e by Tilman Safaris are subject to the booking conditions and cancellation provision of the supplier of the services, transport and accommodation.t.c and we reserve the right to amend our rates in the event of changes in direct cost to us.

CHANGE OF BOOKING

After the booking has been confirmed, should you wish to change to an earlier departure date or postpone your departure, you may do so subject to availability.

INSURANCE

Comprehensive travel and medical insurance is compulsory for guest booking with Tilman Safaris. Ther client acknowlegdes that it is his responsibility to take insurance . The client undertakes to take comprehensive travel insurance to cover his/her personal requirements. This insurance should include cover in the respect of , but not limited to, the following eventualities: cancellation  and curtailment of the safari and service booked, emergency evacuation expenses, medical expenses, repatriation expenses, damage/theft/loss of personal baggage, money and goods. The Safari Company, including  their representative, employees and agents will take no responsibility for any cost, losses incurred of suffered by the guests or guests dependents or traveling companions, with regards to, but not limited to, any of the above mentioned eventualities. Guests will be charged directly by the relevant service providers for any emergency services they may require. lease note that credit card travel insurance is inadequate for a safari. The choice of insurer is the sole discretion of the client.

HEALTH

The client acknowledge being aware of the proposed itinerary and it is the clients obligation to ensure that he/she is medically fit and able to embark upon such a tour. If sickness  or accident interrupts a  tour, Tilman Safaris shall not be liable for any cost or expense arising there from,except if such sickness or accident was caused by the operator willful act or  gross negligence. The company shall not be liable  for any refund, either in total or partial.

Please advice us in advance should you have any special dietary requirements, allergies e.t.c

INDEMNITY

Tilman Safaris acts as an agent in packaging tours and travels arrangements utilizing the products of various travel suppliers. The company makes every effort to engage quality suppliers among the airline, hotels, tour operatos and other service providers to ensure that the various services making up different tours will be carried out efficiently and as specified it does not have direct control over the provision of service of the the operator, the supplier, the operator or suppliers servants and shall not  be liable for any loss, damage, injury, additional cost, delay, irregularity that may be occasioned by any error or default, act or ommission of any supplier in carrying out the arrangement of any tour or otherwise in connection therewith, except in the case of wilful negligence or a willful act or ommission.

Travellers shall be solely responsible for complying with the formalities required by police, custom, health and all other authorities at the point of departur, at the destination and whilst in transit.

The Company may at it’s discretion and without liability or cost to itself at any time decline, cancel or terminate the guests booking in the event of illness, illegality, non-payment of any amount due by it’s client, or if clients interfere with any other member of any group an /or cause any disturbance or nuisance, the client shall in such circumstances not be entitled to any refund. The client undertakes and agrees that he/she will, at all times, comply to a reasonable code of conduct during the safari and will not on any way constitute a nuisance to other person on tour.

Should the company appoint a tour leader or guide in respect of any tour, then the client must accept all reasonable instruction of such tour leader or guide.

The client acknowledge that the service arranged by Tilman Safaris , whether in civilized or remote areas by plane, vehicle, team, boat, horseback, other  conveyance or by foot, contains inherent risks of injury, illness, death, or loss and damage to property, which may be caused by forces of nature, accident , wild animal, negligence of others and other causes known or unknown. The client acknowledges that such risks may be present at any time before, during or after the tour and that medical service and facilities may not be readily available during the tour. The client expressly assumes any and all risk with respect to the activities and circumstances described herein and Tilman Safaris will not be liable on account of any losses, claim, costs, liabilities or damages.

Tilman Safaris shall in no circumstances be seemed to be the agent of the passenger or of the supplier of any service.

The client is aware that the itineraries are flexible and will depend on local condition. The company shall not be liable for any loss, damage to any property; the cancellation or curtailment of any tour; sickness, quarantine, weather conditions, war, strikes riots and or any cause of any nature whatever, however caused and whether as a result of the companys negligence or otherwise.

Tilman Safaris believes that the contents of this website are correct at the time of publishing but all prices and services are subject to changes or withdrawal without notice. The Safari Company will not be responsible for loss or damage arising from any errors or omissions contained in it’s website, literature or information sources.

PASSENGER RESPONSIBILITY

Passengers must not carry any unlawful articles or substances while travel in. If any passenger offends against the prohibitions set out herein, the operator will be entitled to immediately exclude from the tour the offender who will be responsible for his or her own repartitions with any authority. Jurisdiction in all matters where it is or may be necessary to have recourse to the Court, the Courts of the Republic of Kenya shall have sole jurisdiction to the exclusion of the courts of any other country and the law of the Republic of Kenya shall prevail.

PRICE INCREASE

The Safari Company reserves the rights to increase their tour dates due to any increase in airline tariffs, fuel costs, game reserve entry fees, fluctuation of exchange rates, government actions and other factors beyond the companies control. The company will use it’s best endeavors to provide all tours as confirmed, reasonable changes in the itinerary may be made without notice if necessary.

RESERVE ENTRY AND CONCESSION FEES

Reserve entry and concession fees are payable at the time of reservation and are subject to change upon short notice as they are controlled by the Kenya Wildlife Service, Any changes will be passed on in full even for pre-paid clients. In most cases the reserve , park and concession fees will be in the total cost, unless indicated otherwise.

ALTERATION OF ROUTES AND SUBSTITUTION OF ACCOMMODATION

Tilman Safaris reserves the right to alter or substitute routes, refreshments, meals, accommodations, itineraries, tours, services, vehicle and/or arrangements in case of conditions beyond our control like but not limited to road conditions, weather, mechanical breakdown, accident, border closure, local politics or a multitude of other factors beyond our control necessitate. It is however very unlikely that the itinerary would be substantially altered; if alterations are necessary the Leader will decide what is the best alternative, taking into consideration the best interests of the clients. Where a change does occurs, we do everything we can to minimize the effect, but we cannot be responsible for the results of changes or delays. The company takes every care to ensure that itineraries are followed through to the letter but unforeseen circumstances may necessitate changes. Tilman Safaris accept no liability due to the alteration of routes or substitution of properties. Where properties or services are substituted, we will offer substitutes of equal value and standard and we will inform the client of any known changes before arrival.
The Company shall have the right at any time at its discretion to cancel any safari and services or the remainder thereof or make alterations in route, accommodation, price or other details and, in the event of any safari and services being rendered impossible, illegal or inadvisable by weather, strike, war, government or interference or any other cause whatsoever, the extra expenses incurred including but not limited to the cost of flying back home, alternative accommodation, food, personal expenses and all resulting costs are to be borne by the client.

FLIGHTS AND TRANSFERS

For internal flights within Kenya guests are advised to pack in soft bags with a maximum of 15kg per person. Transfers to additional destinations can be arranged and vary in price and duration depending on the length of the journey and the condition of the access roads.

INTERNATIONAL AND DOMESTIC AIR BOOKINGS

Reconfirmation of flight bookings is the responsibility of the traveler. As tour arrangements may be booked to connect with all international and domestic air flights it is your responsibility to keep us updated as to your flight times and numbers.

DISPUTES

Any claim or dispute which may arise between client and the company including any claim for loss or damage due to injury to person or property or any other, must be brought to the attention of Tilman Safaris prior to the client’s departure in order to finalize the issues on the ground at the time. Where this is not possible then they are to be followed up in writing not later than 14 days after departure where the Kenyan legal system will be adhered to exclusively.

PAYMENT OF A DEPOSIT WILL INDICATE AN ACCEPTANCE OF THESE BOOKING CONDITIONS BY THE PASSENGER/CLIENT
